Defendant-appellant John Fox (Fox) appeals his conviction of conspiracy to possess with intent to distribute and to distribute cocaine, in violation of 21 U.S.C. ร§ 846 (Count I), and of interstate travel for the purpose of promoting unlawful activity, in violation of the Travel Act, 18 U.S.C. ร§ 1952 (Count VI). On appeal, Fox asserts that: (1) the district court erred by denying his motion to suppress evidence seized at his arrest; (2) the evidence is insufficient to support his conspiracy conviction; (3) the district court erred in refusing to give Foxs tendered jury instruction concerning the difference between a conspiracy and a buyer-seller relationship; and, (4) the government failed to prove a "business enterprise" within the meaning of the Travel Act.
